Kendall and Zach were called home from their romantic evening because Spike was running a fever. Kendall freaked and got ready to rush her son to the hospital, but Zach talked her into listening to the doctor, who advised that PVH’s ER has more germs than their house. Zach calmly set about caring for the baby, while Kendall hovered nervously, clearly impressed. The relieved couple had just learned that Spike’s fever broke when Del showed up to “ask [Zach] how it feels to get away with murder.”

At the hearing regarding Emma, Annie argued that she is the child’s mother. “I was pregnant; I delivered a healthy baby girl,” she insisted, but Tad pointed out that the baby could have been switched without her knowledge. Cue the woman who helped deliver the infant, to testify on Annie’s behalf and provide footprints as proof. Faced with such evidence, Tad just continued to argue that Dixie is a great mother and that she didn’t cavalierly abandon her baby, all of which Dixie clearly appreciated. Livia, Ryan and Annie then begged the judge not to set a precedent by ignoring New York state law and ordering a DNA test based on wild speculation. When it was time for his ruling, the judge noted that they all clearly care very much for the little girl. “Despite my personal curiosities” (!) “I find no legal basis for granting this petition,” said the kindly judge, who seemed truly upset when Dixie ran out crying. Once everyone was gone, he called Child & Family Services to suggest they investigate the situation.

Jonathan told Erin that he’s prepared for the worst: he’s getting Annie and Emma out of town if a DNA test is ordered. He also insisted to Erin that Tad and Dixie probably won’t be as good as parents to Emma as Annie. After gushing over Emma’s princess outfit, they sent the child to the kitchen (alone!) for crispy marshmallow treats. Not surprisingly, Emma had disappeared by the time Annie and Ryan got back with their good news.

At the Valley Inn, David was begging Babe to tell JR the truth. JR accused David of scheming, as usual, to make his family suffer. Babe and Josh didn’t really argue, causing David to turn on them: “Tell him that you made love to his wife,” he ordered Josh, who confessed that he because is in love with Babe, he’s hoping that her marriage will end. He even added that he “wished” he could hurt JR by confirming he’d slept with her — but he hasn’t. With that, Babe told her father to go. “I wish you’d just disappear forever,” she said sadly, and with a last scowl at Josh, JR took off as well, leaving David to admonish Josh for not destroying the Babe/JR union when he had the chance. JR, meanwhile, declared his deep love and gratitude to his guilty wife, then kissed her. But when he pulled away, she fantasized that he was Josh. “I can’t,” cried Babe. Back at his cabin, David poured himself a drink without seeing Josh sitting on the couch. “Babe just got her wish…. That drink was your last. You just killed yourself,” declared Josh ominously.
