Happy Labor Day! DAYS OF OUR LIVES was preempted today.

Tuesday

Max and Steph smooched and discussed how good it felt to be free. Steph wanted to plan their trip back home. Max said he couldn't do that. Steph couldn't believe Max wanted to stay in France so his sister could con him some more. Steph realized Max wanted to see the good in Melanie, but was sure he was wrong about his sis. Max said he couldn't give up on Melanie. Steph vowed to stay by his side and help him see this through.

Abe arrived at the hospital, wanting to spend time with Theo. He and Lexie discussed their autistic son and the tension between them as they tried to deal with him. Abe realized Lexie was more informed on autism than he was. Lexie said she didn't mean to make Abe feel inferior and swore she wasn't judging his behavior in regards to Theo. They both just needed to be there for their boy. Theo emerged from his therapy session with his counselor, who said things went well. Lexie, Abe and Theo headed to the park. While Theo played, Abe and Lexie shared their individual frustrations about dealing with their son.

Tony spoke to Stefano on the phone as John, Marlena, EJ and Anna listened in. Stefano noted he was returning to the mansion to reclaim what was rightfully his. Bo walked in and asked who Tony was talking to. He grabbed the phone and chatted with Stefano, who promised Bo would be seeing him soon. John entered and asked why Bo was there. Bo wanted to discuss the Hollingsworth case — specifically, what happened to Paul. Marlena begged John to not let Stefano return. John promised his big brother wouldn't be moving in and vowed to protect Marlena. John then urged Bo to make sure Stefano stayed away from Marlena. If the cops didn't take Stefano out, he would. John asked EJ about his legal holdings to the DiMera house, etc. Stefano strolled in, announcing the house was his. Bo arrested Stefano, while John told him to enjoy his new home — the state prison.

Steve arrived at the police station and found Hope working on Paul's case. He asked how Bo was holding up. Hope admitted the investigation by internal affairs had them both losing sleep. Hope got a call saying Paul had been spotted, and she promptly raced out.

Philip met with a mystery man and thanked him for some information. Meanwhile, Morgan reunited with her father. She asked Paul what happened to him and where he'd been. Paul wouldn't explain; he said it was best Morgan didn't know what he was involved in. Paul promised he was through running and was going to turn himself in. Morgan's cell rang and it was Philip. He asked to speak to Paul. Philip told Paul he cops knew where he was and he was going down. Seconds later, Hope arrived with the cops, who handcuffed Paul.

Later, at the station, both Stefano and Paul were carted in. Steve barged in and tried to attack Stefano, demanding to know what he'd done to little Joe. Roman got a call from the DA. He hung up and informed all there were no charges against Stefano and none would be filed. They had to let him go. Steve and Bo erupted. Abe entered, noting he'd just heard from the mayor and governor and was told to let Stefano go, too. Stefano was released. Meanwhile, Philip chatted with Paul in another room, telling him he'd made a big mistake switching alliances. Paul said he was ready to take responsibility for his actions. Later, Philip tried to make amends with Morgan, since Paul turned up alive and well. She wasn't interested. Although she'd cared for Philip and thought they could have had something wonderful, she now knew she was wrong about him.

Back at the mansion, John, EJ and Tony continued to discuss Stefano's holdings. EJ explained that since Stefano was no longer incapacitated, the entire DiMera empire was up for grabs. Soon, Stefano returned and walked smack into Marlena, noting there was “unfinished business” between them. Then, he marched into the living room and chastised John, EJ and Tony, calling them all worthless ingrates! Stefano ordered everyone out of the house. John's cell rang and it was Roman, demanding he come down to the station at once. Paul was in custody. "Damn this day!" yelled John.

Wednesday

Chelsea talked to Theo as he awaited therapy, and Daniel walked in. The pair went off to chat. Daniel told Chelsea he'd never meant to hurt her. His fling with Kate was in the past and over. Daniel insisted he wanted a future with Chelsea. She understood what happened between Daniel and Kate had nothing to do with her, but said it still hurt. Daniel insisted he wasn't going to let Chelsea walk out of his life. He'd give her time to think, but wouldn't accept they were over. He wanted to try again. Chelsea said it wasn't going to happen. She could never be with Daniel without thinking of him with Kate. Later, Chelsea told Theo she'd be going away for awhile.

Stefano chatted with EJ and Tony about John, noting his brother's world was about to come tumbling down. EJ wondered how his father got released from the cops so quickly. Stefano said he had friends in high places. Then he berated his kids for allowing him to be carted off to a facility so easily. Stefano said he was disowning EJ and Tony. Chloe and Lucas arrived. Stefano was stunned to learn Lucas was living there. Lucas said he was there to get his things and go. The bell rang and it was Victor. Stefano and Victor decided they were back in business. They also agreed to put pressure on Paul to take the fall for Philip and John. Later, Stefano interrupted as Lucas told EJ he was moving out. Stefano was thrilled. Now if only the rest of them would leave. Tony and EJ said they had no intention of going anywhere. Stefano couldn't believe his sons were challenging him. He announced that now that he was back and free, he'd be calling the shots around the mansion.

At the cop shop, Hope, Roman and Abe were outraged over having to let Stefano go on the DA's orders. Morgan waited to see Paul while Philip tried to make amends, to no avail. Bo told Philip even though Paul was found alive, it didn't mean they were off the hook. Internal Affairs was bound to ask about the tape. John arrived, and Morgan asked what he'd done to her father. Bo asked, too. John asked why Stefano was back at the mansion instead of behind bars after everything he'd done. Bo explained the DA wasn't pressing charges against Stefano. Abe suggested John press charges against Stefano. Later, Roman took Paul's statement. Paul admitted to planting cocaine on John's ships and setting the fire on the docks. Roman suggested John kidnapped Paul and that Philip paid him to plant cocaine on John's ships. Paul swore he had not been coerced. He'd done the crime and was prepared to serve the time. Then, he told Morgan goodbye and was carted away. John got a call from Stefano, noting John had him to thank for Paul confessing to everything. Stefano ordered John to remain silent about everything he'd done to him. If he didn't, Paul would retract his confession and the truth would come out. Meanwhile, Philip got a call from Victor telling him everything had been taken care of. Philip was in the clear. Roman was stunned when John said he wouldn't press charges against Stefano. On his way out, however, John ran into Philip and said he wasn't calling a truce with him or Stefano.

In Paris, Melanie stopped by Max's hotel room, and the pair had a heart-to-heart about their upbringing. Melanie revealed she'd gotten into trouble when she was in the sixth grade for stealing. Trent couldn't deal with it, so he shipped her off to a series of boarding schools. That is, until she convinced him to let her come to France. Melanie said Trent meant well, but they just didn't get along. Max filled Melanie in on how Trent abandoned him as a child. He explained he'd been sent to an abusive foster home, but was rescued by Frankie and eventually adopted by the Bradys. Melanie's cell rang and it was Trent. She made excuses about not returning his calls and hung up on him. Max invited Melanie to come back to Salem with him and Steph. Melanie refused, not wanting to put herself under Trent's control. Later, Max met with Nick and told him Melanie opened up to him, but he got the feeling she was hiding something. Meanwhile, Melanie took a cryptic phone call.

Thursday

Abe and Lexie were spending time with Theo in the park when Steve and Kayla showed up with Joe. Steve approached Theo, who ignored him. Kayla suggested Steve, Abe and Joe go feed the birds. Alone, Lexie told Kayla she and Abe were having problems regarding handling Theo's condition. Lexie worried she wasn't a good mother and should be able to handle this as a doctor. Kayla sympathized. Lexie went on about her busy life. She mentioned the hospital lockdown and how she could lose her job over it. Lexie said she'd gladly give up her job, if her son could be like other kids. She went on about what the future held for Theo. Kayla told Lexie she had plenty of support. Meanwhile, Abe and Steve discussed Theo's autism, too. Abe said he and Lexie viewed things differently and it usually caused fights. The guys returned, and Steve, Kayla and Joe left. Abe went to fetch Theo, and he had a meltdown. After father and son left, Lexie fantasized about the kid Theo could have been and cried. Later, Steve and Kayla discussed Abe and Lexie's heartbreaking situation.

As a worker left the mansion carrying a painting, Tony asked Stefano what was going on. Stefano informed Tony he was giving the DiMera estate "a facelift." Now if only he could evict all the freeloading tenants that had settled there. EJ said he and Tony weren't leaving and handed Stefano a legal paper. EJ insisted he wanted to restore honor to the DiMera name. Stefano maintained the DiMera legacy was in good hands — his! EJ noted Stefano no longer ruled the family. Stefano asked to speak to his sons alone. He went on about the high hopes he'd had for Tony and called him weak. Tony said Stefano's idea of being strong and bold meant being ruthless and arrogant, and that wasn't who he was. EJ returned and told Stefano whatever Tony said went double for him. Stefano said he felt closest to EJ. Elvis didn't buy it and called his father a master of manipulation. Legacy or no legacy, he didn't want to be like Stefano. Stefano remained undeterred. He summoned Tony back and suggested he and his sons join forces. EJ and Tony stood firm and responded no. Alone, Stefano perused an old photo album and muttered about how important family was to him.

Trent ran into Marlena at the pub and asked if he could buy her a drink. Marlena declined, walked off and ran into John. John asked her to stay at the mansion another night. Marlena said no, since Stefano was there. John wondered if it really had something to do with their sexual romp the day before. Annoyed, Marlena walked over to Trent and took him up on his drink offer. Nicole strolled in, and John told her he didn't like Trent. Nicole tried to get John to pay attention to her, but he was fixated on Marlena. "I thought you two were separated," said Nicole. "She's still my wife," responded John. Trent questioned Marlena about John being jealous. Marlena noted that she and John were married, but his priorities were elsewhere. "Then why does he keep looking over here?" asked Trent. Nicole attempted to give John relationship advice. Namely, if he loved Marlena, tell her! John wondered why Nicole was eager to get him and Marlena back together. Nicole snapped, calling Trent "a no-good bastard who deserves to die." Meanwhile, Trent asked Marlena out to dinner. Marlena declined, since she was married. Trent left, and John approached Marlena's table ready to heed Nicole's advice. Before he could say a word, Marlena announced it was time she filed for divorce.

Nicole shared an awkward moment with EJ outside the pub. She said she understood his wanting to stay with Sami, since they had a child. EJ, however, revealed he had lingering thoughts about Nicole.

Friday

At the pub, Lucas told Chloe he was planning to stay at the Horton cabin and invited her along. "Are you out of your mind?" interrupted Kate, who started coughing uncontrollably. EJ arrived and told Sami there was no news on Allie's custody, but they should hear something by the end of the day. Sami bemoaned the possibility of losing Allie. EJ wondered how she felt about losing Lucas. Sami didn't care who Lucas dated. She was only concerned about losing Allie. EJ brought up their conversation in the stairwell. Sami didn't regret 'fessing up to her feelings for him. Kate asked if Lucas was sure he wanted to get involved in another doomed relationship. Chloe decided to leave. Lucas asked her to get the keys to the boat and boathouse from Maggie. Kate continued trashing Chloe, noting she'd turned Brady into a drug addict and used Philip. Lucas defended Chloe=2 0and said he could make his own decisions. Mickey arrived and announced there was still no decision in Allie's custody case, while EJ headed to the office.
Chloe met with Maggie, who gave her the aforementioned keys. Maggie chatted with Chloe about her relationship with Lucas. Maggie talked about falling in love with Don, when she thought Mickey had died. She called Don her rebound guy. "So you think Lucas might be my rebound?" asked Chloe. Maggie asked if Chloe had moved on from Brady and if Lucas had cut emotional ties with Sami. Chloe wasn't sure. Maggie encouraged Chloe to think long and hard about what she really wanted; particularly, if Lucas was awarded custody of Allie. Maggie left. Nicole arrived, and Chloe admitted Maggie was giving her relationship advice. Nicole suggested headed to the pub to talk.
Lexie confided her troubles in Daniel: Theo's condition, her problems with Abe, and the hospital review board coming down on her about the lock down. The pair embraced, when Abe walked in. Abe asked for a moment alone with Daniel and told him to stay away from Lexie. After Daniel left, Abe reminded Lexie of her past sexcapades. Lexie was annoyed Abe assumed she was having an affair with Daniel and insisted they were just friends. Later, Abe and Lexie met with a counselor. Abe mentioned Lexie's infidelities and how distant she'd become. Now, she was cozying up to Daniel. "I've lost my little boy and all you can20talk about is the affairs I've had!" barked Lexie, who was distraught her son wasn't like other kids. The counselor left, and Abe reassured Lexie she was a wonderful mother. The pair embraced.
Hope ran into Daniel and asked what happened that made Chelsea run off to France. Hope said she wanted to help, but Daniel refused to spill t he details. Daniel insisted this was something they had to work through themselves.
Back at the pub, Mickey got a call and told Lucas that Maggie had given Chloe the keys to the cabin. Mickey went off to talk business with Kate, while Sami freaked over the idea of Lucas "shacking up with" Chloe. She didn't want her around Allie. Lucas noted Chloe would be Allie's stepmother someday, just as Nicole and Chloe walked in. Chloe wondered if she was ready to be a mother. Nicole urged her to tell Lucas about her concerns. Lucas went to talk to Chloe, noting if he got custody of Allie all three of them would go to the cabin tonight. Chloe said she wasn't going to the cabin. EJ returned, and Nicole asked if he meant it when he said he couldn't get her out of his system. EJ said he did, but his situation with Sami was complicated. Nicole, who was losing patience, told EJ to figure out what he wanted.
Suddenly, Mickey stormed in and announced the judge had decided to grant joint custody of Allie. "There is no way in hell I am agreeing to that!" spat Sam.
